This notice sets out the terms and conditions of usage for an online account on the website of the British Trust for Ornithology ("BTO", "us", "we"), and its related online services. To hold and use such an account we need you to confirm that you agree to such terms and conditions.
You can access many areas of our website without registering your details with us but participation in certain projects and access to some supporter services are only available if you register and use an online BTO account. The terms and conditions of registration that follow supplement our general Website Terms of Use, and are in accordance with our Privacy Policy. BTO takes your privacy very seriously; we will only use your personal information in accordance with the terms of our Privacy Policy. By submitting information to BTO via your online account you acknowledge and agree that you have read and accept the terms of our Privacy Policy. If under 18, when requested, you will need to provide BTO with written permission from a parent or guardian to allow us to process and store your personal data. The services available to you before this permission is received may be limited.
1.Registration
By registering here and creating your online BTO account, you can participate in projects and access services that we offer using the same account credentials (Username and Password). If a particular project you wish to participate in, or service you wish to use has additional terms and conditions, you will be asked to accept these at the point of signing up.
What you agree to in registering for an account

1.3 You will not attempt to maliciously gain access to or use administrative privileges, knowingly exploit, or deny access to our provision of online services.

1.6 You will not knowingly provide false information to BTO.

1.7 You warrant that any information you contribute to BTO contains only data that you have the right to make available to BTO, is not defamatory, and does not infringe any law.

1.8 You indemnify BTO against all legal fees, damages and other expenses that may be incurred by BTO as a result of your breach of the above warranty.

1.9 If under 18 years old, you must inform BTO of your date of birth when registering for an account. The services you may use will be limited until you have provided written permission from a parent or guardian for BTO to hold your personal data and to contact you for the purposes of administering services you wish to participate in.
What we agree to provide to you as a registered user

1.10 We will ensure continued access to your account and associated services, periods of planned maintenance and temporary failure of service availability notwithstanding

1.11 Within reason, we will ensure the accessibility of online services across common browser technologies and will accommodate commonly known accessibility needs

1.12 We will provide the ability to update your personal details (including your contact preferences) and your password at any time by allowing you to access your account and making any necessary changes; this will update your details across all services that you have subscribed to or projects you are participating in.

1.13 We will ensure that the BTO holds the personal data of contributors to our online systems securely and in a way that meets the provisions of data protection legislation in force at the relevant time in the United Kingdom. The BTO is registered under the Data Protection Act 1998.

1.14 We will provide reasonable support to users encountering difficulties accessing accounts and services; contact websupp@bto.org to report any issues.
2.Terms of Service Provision

2.1 If you breach any of the terms of registration we reserve the right to close your account; if we do so, we may also terminate other services and participation in certain projects.

2.2 If you wish to deactivate your account please inform us using the contact methods provided in the footer of each page of the BTO website.

2.3 Following termination of your account, we may no longer be able to allow you to participate in certain projects or access certain services.
3. General Terms

3.1 No waiver by us of any breach of these terms shall constitute a waiver of any other prior or subsequent breach and we shall not be affected by any delay, failure or omission to enforce or express forbearance granted in respect of any of your obligations.

3.2 The rights and remedies of the parties under these terms are independent, cumulative and without prejudice to their rights under the law.

3.3 These terms are not intended to create and shall not create any rights, entitlements, claims or benefits enforceable by any third party by virtue of the Contracts (Rights of Third Parties) Act 1999.

3.4 These terms and/or your use of the website shall be governed by and construed in accordance with English law and the English Courts shall have exclusive jurisdiction over any dispute which may arise.
